Making a Will

Making a Will can help ensure your assets are distributed according to your wishes while providing peace of mind for you, and your loved ones.

Why do I need a Will?

Making a Will in Scotland is a sensible and necessary step, but not everyone gets around to it before they die. Without a Will, the government will use the law of intestacy to determine how your estate is distributed, which may not reflect your choices.

What if I die without making a Will?

If you die without a Will, then the government will effectively write it for you by applying the laws of intestacy, using a generic set of rules that apply to everybody. Almost certainly the consequences of this process will not reflect the choices you would have made yourself.

Our Standard Scottish Wills

Our Standard Scottish Wills have five key elements that ensure that your estate is distributed exactly as you want:

  • Appointment of trusted executors for your estate
  • Specific Legacies: What do you want to leave to whom?
  • General Beneficiaries: What happens to the rest of your estate?
  • Funeral Requests: Avoid family arguments and set out your wishes
  • Children under 16: Appoint a legal guardian for peace of mind

We also offer:

Inheritance Tax Planning

Inheritance Tax planning may be a consideration. For example, all of us have an allowance of £325,000 before any inheritance tax is due. If you are married or in a civil partnership, then these allowances are combined. However for unmarried partners this allowance dies with them leaving the surviving partners with only their allowance. An Inheritance Tax Will can protect the first person’s allowance in full.

Protective Property Provision

We understand that sometimes your circumstances may change, and you may wish to protect your assets. Our team of legal experts will help you create a Protective Property Provision to ensure that your partner does not leave your assets to someone else after their death. Especially if your partner goes on to marry someone else.

Secure Will Storage

We understand that your Will is a crucial document. And sometimes these documents can be lost over time, this is why we provide secure, fire-proof and flood-proof document storage for Wills. Therefore, you or your family will never need to worry about spending ages trying to find your Will as it can be reliably accessed.

As a result of storing your Will with us, we provide storage users with unlimited free updates to ensure that your Will always reflects your current circumstances, as well as saving you money in the long term.
